About These Terms
Effective date: 19 June 2026 Trailworks Pty Ltd (ABN 52 691 737 229) is an Australian company trading online from Unit 6, 280 Great Southern Rd, Bargo NSW 2574, Australia.
These terms apply to consumer and business purchases made directly from Trailworks through the website, a quote or invoice. By placing an order, you offer to purchase the selected goods on these terms and any product-specific or written quote terms disclosed before payment.
Consumer Rights Come First Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law and, where applicable, New Zealand's Consumer Guarantees Act 1993 and Fair Trading Act 1986. If these terms conflict with a non-excludable right, that right prevails.
Orders And Acceptance Website listings are invitations to order. A contract is formed when Trailworks accepts the order by issuing confirmation, accepting payment or starting custom work, whichever occurs first. An automated acknowledgement does not require us to accept an order affected by an obvious pricing error, unavailable product, suspected fraud, shipping restriction or unlawful request.
If we cannot accept an order after taking payment, we will refund the affected amount promptly.
Product Information And Fitment We take reasonable care with descriptions, dimensions, images, compatibility and availability. Screen colours and handmade or powder-coated finishes can vary within reasonable manufacturing tolerances.
You must provide accurate vehicle, model, year, body, measurements, intended use and other requested fitment information. Do not rely on a product being fit for a particular purpose unless that purpose and relevant details were disclosed to Trailworks and we confirmed suitability. This does not reduce any statutory fit-for-purpose guarantee.
Prices, Currency And Tax Website and checkout prices are in Australian dollars and include Australian GST where applicable. Mandatory charges known at checkout are included in the total displayed before payment; delivery may be added separately where shown.
Online checkout currently supports Australian delivery only. Any New Zealand sale must be separately quoted or agreed in writing and will state freight and known tax treatment before acceptance.
Payment Payments are processed through Stripe using the methods shown at checkout. Payment must clear before dispatch unless written credit terms apply. Trailworks does not store raw card numbers or CVVs in its application.
If a payment is reversed, disputed or unauthorised, we may pause fulfilment while the issue is investigated, without limiting either party's legal rights.
Receipts And Tax Invoices Trailworks sends an electronic order receipt after confirmed payment where a valid email address is available. If you require a GST tax invoice, contact sales@trailworks.com.au. Where Australian law requires us to provide one, we will do so within the required period.
Stock, Lead Times And Custom Work Stock and lead-time information is an estimate unless expressly guaranteed. Custom or made-to-order work may begin after acceptance and may require a deposit. Any non-refundable deposit, progress payment, design approval or cancellation charge will be disclosed and agreed before the custom order is accepted.
Delivery And Collection Delivery and collection are governed by the Shipping Policy. You must provide accurate contact, address, access and unloading information. Ownership passes when Trailworks receives cleared payment in full. Risk passes on delivery or collection in accordance with the agreed service and applicable law.
Inspection, Installation And Safe Use Inspect goods before installation and follow supplied instructions, ratings and warnings. Installation or modification should be performed by a suitably qualified person where the product, vehicle, electrical work or law requires it.
Trailworks is not responsible for damage caused solely by misuse, incompatible unauthorised modification, failure to follow instructions or installation that was not performed with reasonable care and skill. This does not exclude responsibility for a defect, misleading representation, negligent act or non-excludable consumer guarantee.
Returns, Faults And Warranties The Return Policy explains the voluntary 14-day change-of-mind process and statutory remedies. Consumer guarantees operate independently of any written manufacturer or Trailworks warranty and may continue beyond a stated warranty period.
Cancellations Contact sales@trailworks.com.au promptly to request cancellation. Standard-stock orders can usually be cancelled before dispatch. Custom, special-order and made-to-order goods may not be cancellable after materials are committed or production starts, except where law provides a right to cancel. Any agreed cancellation amount must reflect the disclosed terms and applicable law.
Liability To the maximum extent permitted by law, Trailworks is not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by the customer's unlawful act, misuse or failure to take reasonable steps to avoid loss.
This limitation does not apply to fraud, wilful misconduct, personal injury caused by negligence, breach of a non-excludable consumer guarantee, or any liability that law does not permit us to limit. Where liability can lawfully be limited for goods or services not ordinarily acquired for personal, domestic or household use, it is limited to the remedies permitted by the applicable law.
Intellectual Property And Website Use Website content, branding, product media and designs remain owned by Trailworks or its licensors. You may use the website for genuine enquiries and purchases, but must not interfere with its security, scrape it at unreasonable scale, impersonate another person or use content commercially without permission.
Privacy Personal information is handled under the Privacy Policy. Stripe, Clerk, couriers and other providers may independently process information under their own terms and privacy notices.
Disputes And Governing Law Contact sales@trailworks.com.au first so we can investigate and attempt to resolve a dispute promptly. Australian customers may also contact their state or territory consumer agency or the ACCC for information. New Zealand consumers may contact Consumer Protection, the Commerce Commission or the Disputes Tribunal as appropriate.
These terms are governed by New South Wales law and the courts with jurisdiction there, but that choice does not remove mandatory consumer rights or a consumer's right to use a court or tribunal available under applicable law.
Changes The terms applying to an order are those presented or incorporated when the order is accepted. We may update terms for future orders by publishing a revised effective date; changes do not retrospectively alter an existing contract unless both parties agree or law permits.
